Examples of how Islamic courts punish oppressive husbands and sons

Husband who hit pregnant wife handed nine months

Jeddah: The Criminal Court in Jeddah has sentenced a man to nine months in jail for beating his wife and insulting her by calling her “stubborn and ignorant.”
The man has also been required to make a written pledge not to go near his wife, while the victim has been entitled to receive her rights.

A source revealed to Al-Watan newspaper that the woman filed a case in the court against her husband — who she had been separated from for seven months without divorce — detailing his constant violence and physical abuse.
In the latest incident, he beat her to the ground in their home because she was heading to the store, and kicked her in stomach, despite her being five-months pregnant at the time.

“The citizen also lodged a complaint with police, who transferred her to King Fahad Hospital in Jeddah for a checkup,” sources revealed.

“The medical report showed clear signs of abuse, indicating the patient suffered from scars and bruises on her body due to the violent beatings. She needed 15 days to recover.”
Her medical report confirmed that she also suffers from psychological problems, depression and anxiety.

She said her husband previously pulled her hair and hit her head against the wall, forcing her to leave with her seven-year-old son and live in a rented house until her divorce is finalized, sources said. “But her husband found her and beat her.”

excerpts from the E-Book

The Fire within the Ocean: The Qur’an mention at verse Ath Thur 52:6 “And by the sea kept filled (or it will be fire)” . Or another translation that say “And the sea that contain fire within”. Without reading into another sign of Allah SWT in the real ocean, this verse would be quite puzzling. This verse indicates that there are source of heat within the ocean. This is the magnificence reason for discovering energy resources within the deep of ocean, the dynamism of ocean, the physical/biological/chemical condition of the ocean. The science has been able to probe deep ocean and beneath, to collect data and reported that there are fire, immense heat, high energy and energy potential within the ocean

The Layers of the Ocean and the Darkness of the Ocean: The Qur’an also reveals, long before mankind can goes into the deeper water with submarine, that deep ocean is totally dark. Perfect darkness with layers of waves, one after another. Verse AnNuur24:40 reveals: “Or is like the darkness in a vast deep sea, overwhelmed with waves topped by waves, layers up darkness upon darkness; if a man stretches out his hand, he can hardly see it! And he for whom Allah has not appointed light, for him there is no light”. Ocean has physical layer characteristics like pressure, salinity, temperature, density, light intensity, chemical composition, and biological distribution. Vast volume of ocean water never have homogeneous in term of physical, chemical and biological characteristic.

ISLAM EVEN ENCOURAGES TO INDULGE IN SMALL FORMS OF ASSISTANCE

Allah says " So woe to those ......And (those who) withhold [simple] assistance". [Ma`oon]  [Qur'an 107: verse 7]

Al-Masudi narrated from Sulayman ibn Kuhayl  who reported from Abul-Ubaydin that he asked Ibn Mas`ood (r.a) about what al-Ma`oon is (means): He (r.a) said : It is what the people give to each other (as simple assistance such as) like an axe (to cut wood, etc.) [1] a pot (for water) [2] and similar items [3]

[Ref: Tafseer ibn Katheer]

In modern day terms

[1] a bike, or a car, or a phone call
[2] water bottle,
[3] coffee, sugar, pulses to your neighbor etc.

PROHIBITION FROM DEFECATING OR THROWING HARMFUL THINGS ON THE ROADWAYS

[RT] A man came asking a fatwa from Abu Huraira radhiallahu `anhu regarding the practise of (some customs/countries/group) to urinate/excrete on the roadways . To this Abu Huraira (radhuallahu `anhu) said I heard everything (regarding which I give you all a fatwa) from the Prophet sallalahu `alayhi wa sallam and he said : “ Whoever leaves (or throws) something spiteful on the used roadways among the roadways of Muslims then upon him is the curse of Allah and that of the angels and of all mankind. “

THE IMPORTANCE ALLAH GAVE TO HEALTH FOR HIS CREATIONS

Imam Ibnul-Qayyim (d.751 AH) laid down some mighty principles in his excellent work commonly known as “At-Tibb An-Nabawee” (The Prophetic Medicine) which is actually a part of his monumental authorship entitled “Zaad al-Ma`aad fee Hadyi Khayr al-Ibaad.” I will recall here some of what he (may Allah have mercy upon him) has written about the “principles of medicine” that the scholars of medicine and religion have mentioned in their books.
Ibn al-Qayyim (rahimahullaah) stated:
“The principles (qawaa’id) of bodily medicine are three:
  1. The preservation of health,
  2. The expulsion of harmful substances,
  3. Protection from harm.
Thus, Allaah (the Most High), has mentioned has mentioned these three principles in three most relevant places:

Ibn Khaldun and taxes

The 40th president of the United States, Ronald Reagan famously stated in a piece in the New York Times in 1993,

“May I offer you the advice of the 14th century Arab historian Ibn Khaldun, who said: “At the beginning of the empire, the tax rates were low and the revenues were high. At the end of the empire, the tax rates were high and the revenues were low.”

And, no, I did not personally know Ibn Khaldun, although we may have had some friends in common!”1

Although one may agree or disagree with the conservative economic policies of Ronald Reagan, there is no denying the genius of the man he is quoting – Ibn Khaldun. He was centuries ahead of his time. His monumental work, the Muqaddimah, published in 1377, is hard to categorize. All at once it is a resource on history, Islam, science, sociology, economics, politics, warfare, and philosophy. One article on the entire book would be a disservice to Ibn Khaldun and the great amount of knowledge he left for subsequent generations. Instead, this article will focus only on some of his economic ideas, which centuries later form some of the basic ideas we use in government taxation today.

Islam mandates that the son is responsible for his Mother father sister and brother

Islamic upbringing vs western upbringing
-----------------

ابدأ بمن تعول: أمك وأباك وأختك وأخاك ثم أدناك أدناك

Taariq Al-Muhaarbi narrated as Marfu` (i.e via the prophet who said): “Begin with spending on those for whom you are responsible: your mother, your father, your sister, your brother and then who is near to you in order of relationship.

[Ref: Nasa'ee]

Lessons
-------

1. In Islam a son is by default obliged to take care of his parents so much so that the messenger of Allah (sallalahu `alayhi wa sallam) said that the son and his earning is of the parents. Compare this with the western habit and culture and how they treat their parents right from when they start earning. In Arab and eastern (Indo pak bangladesh indonesian brunei and malaysian) lands  - Muslims are raised with this notion since childhood that the son is responsible for his parents and other dependants.

2) This is also one of the reasons why the inheritance share is more for the male than the female because the males are by default given a bigger responsibility to attend to

3) This is obviously the case when they need support and not in situations when your parents or sibblings are millionares or have enough sources to live properly and healthly

4) This is yet another hadeeth from the other numerous one's that shows the superior position of a mother. Unlike the vast majority of western culture, the Muslims don't leave the houses at the age of 18 or send a christmas card once a year or not know who their father was. Offence is not intended here but simple truth.

Islam teaches Manners to observe while meeting your women folk

The saying of Allaah:

{ O you who believe! Enter not houses other than your own, until you have asked permission and greeted those within them; that is better for you, in order that you may remember. } [An Noor: 27]

Ibn Katheer comments:

Hushaym stated: Ash’ath ibn Suwwaar narrated to us…that ibn Mas’ood said: “It is upon you to take permission when entering upon your mothers and your sisters.”

Ash’ath said: On the authority of ‘Adee ibn Thaabit who said: A woman from the Ansaar said to the Messenger – صلى الله عليه و سلم -:

“O Messenger of Allaah, sometimes I am in a state at home in which I do not like anyone to see me in, not my father nor my sons, but men amongst my relatives keep walking in on me while I am in that state.”

So the following verse was revealed:

{ O you who believe! Enter not houses other than your own, until you have asked permission and greeted those within them... }

‘Ataa ibn Abee Rabaah asked Ibn ‘Abbaas: “Should I seek permission for entering upon my orphaned sisters who live with me in the same home?”

He replied: “Yes.”

So I repeated the question so that he may permit me but he refused saying:

“Would you accept to see her unclothed?”

I said: “No.”

He said: “Then seek permission.”

So I repeated myself again, he said:

UNPARALLELED HONOURING OF ONE'S MOTHER FOUND ONLY IN ISLAM

Abu Hurairah (radi Allahu anhu) narrated: A man came to  Allah’s Messenger (sal Allahu alaihi wa sallam) and said, “O Allah’s Messenger! Who is more entitled to be treated with the best companionship by me?” The Prophet (sal Allahu alaihi wa sallam) said, “Your mother.” The man said, “Who is next?” The Prophet  (sal Allahu alaihi wa sallam) said, “Your mother.” The man further said, “Who is next?” The Prophet  (sal Allahu alaihi wa sallam) said, “Your mother.” The man asked ( for the fourth time), “Who is next?” The Prophet  (sal Allahu alaihi wa sallam) said, “Your father.”

[Narrated by Imam Muslim in his Saheeh Book 32, Hadith 6181; Ibn Maajah Vol. 5, Book 33 Hadith 3658 ; Sunan at-Tirmidhi Vol. 4, Book 1, Hadith 1897, Adab al Mufrad Book 1, Hadith 3 & 14; and there are many similar ahaadeeth. ]

Ibn Salamah As-Sulami narrated that the Prophet (p.b.u.h) said:

“I enjoin each one to honor his mother,I enjoin each one to honor his mother,I enjoin each one to honor his mother(three times), I enjoin each one to honor his guardian who is taking care of him, even if he is causing him some annoyance.”

[Sunan Ibn Maajah Vol. 5, Book 33, Hadith 3657]

The Prophet (peace and blessings of Allaah be upon him) heard the recitation of Haarithah ibn al-Nu’maan in Paradise and said:

He attained this level (in paradise) because of Honoring his mother

[ Narrated by Ibn Wahb in al-Jaami’ (22); classed as saheeh by al-Albaani in al-Silsilah al-Saheehah (913).]

A'ishah (May Allah be pleased with her) asked the Messenger of Allah (PBUH): "Who has the greatest rights over a woman?" He said, "Her husband." She asked, `And who has the greatest rights over a man?" He said, "His mother."

[Reported by al-Bazzar with a hasan isnad. See Majma' al-Zawa'id, 4/308, Bab haqq al-zawj 'ala'l-mar'ah, Hakim, Fiqh us-Sunnah. But this is a weak (da’eef) hadeeth, which was classed as such by al-Albaani in Da’eef al-Targheeb wa’l-Tarheeb, 1212, and he criticized al-Mundhiri for classing it as hasan. However the meaning remains right due to corroborating evidences]

From al-Miqdam bin Ma’adee Karb al-Kindee on the authority of the Prophet -sallAllaahu alayhi wa sallam- who said: ‘Indeed Allaah orders you to fulfill the rights of your mothers, then to fulfill the rights of close relatives then those who are after them.’

[Collected in ‘Silsilah Saheehah’ No.1666]

From Muhammad who said: ‘There was a date palm which bore one thousand dates, so Usamah bin Zayd –RadhiAllaahu anhu- went to these dates and cut them off the tree due to their beauty. He was asked about it, so he said: Indeed my mother mentioned to me that she would love to have them, and there is nothing from the Duniya that my mother wants and I have the capability of getting except that I will get it for her.’

[Collected in ‘Mukarim al-Akhlaaq’ p.225, taken from ‘Akhbar as-Salaf’ p. 268]

From Ibn Abbas –RadhiAllaahu anhu- that a man came to him and said: ‘I proposed to a woman but she refused to marry me, someone else proposed to her and she liked him and married him. I became jealous over her and I killed her, can I repent from this?’

Ibn ‘Abbas asked: ‘Is your mother alive?’

SOLUTION 4 - SAVE HIJAB SAVE LIVES AND HONOUR

Note: As mentioned in the title description of our website that

We intend to illustrate how the Islamic shar`iah , contrary to what it is biased and infamously portrayed to be, is in fact the very need of this hour both but not limited to; current events in our society and social customs

Precisely so, we choose current events and occurrences present around us today and use it as an example to illustrate how the Islamic law (shar`iah) serves as a solution to prevent such mishaps. We do not intend to generalize the specific chosen examples upon the majority of people nor do we intend to attack or insult any body or religion per say, rather our only motive is to compare and contrast on how effective and needed the islamic laws are.

Islamic contributions 1 - Etiquettes and Manner of communicating

Allahu Akbar, How many of us have read through books of communication ettiquites or manners or etc?

we go through counselling sessions and what have you but dear oh dear ! Muslims have you even once wondered that all these books have to offer when it comes to ettiquites are already taught by your prophet and his folllowers?

For example almost all the books on proper communication skills include how one must fully turn towards the person addressing us and pay attention to what he speaks .

this is the sunnah of the prophet sallalahu `alayhi wa sallam !!!

Another example of not interrupting people when they talk even if you happen to know what he was saying.

Sayyiduna Ibrahim Ibn Junaid (one of the earlier scholars of past centuries) rahimahullah said, “A wise man once said to his son, “Learn to listen properly just as you learn to speak properly.”“ Listening properly means, maintaining eye contact, allowing the speaker to finish the speech, and restraining yourself from interrupting his speech, even if you are aware of what he is saying.

This particular fatwa (advice/opinion) of Ibrahim ibn Junaid is something many many early scholars also gave. For example Abdul wahhab al-Quraishi al-Misri one of the companions of Imam Malik (d 93 Ah or 711 CE) and Layth ibn sa`ad.

Also by Khalid ibn Safwan at-tamimi (died prior 200 Hijri or prior 800 CE) said the same. he was the companion or advisor to both the khalifah `Umar ibn abdul azeez as well as Hisham ibn Abdul Malik

Even Imam sufyan ath-thawri from the first three centuries of Hijra calender and later on imam Khateeb al-Baghdadi said the same.

These manners are first and foremost taught by Islam ! open the widely available english translated book Adab al-Mufrad by Imam Bukhaari and read. Read how manners were something the Muslims had a Monopoly on. And now muslims forget their glorious ancestors and resort and credit tom dick and harry for ettiquites.

Throughout the late 19th century, and well into the 1950′s, Africans and in some cases Native Americans, were kept as exhibits in zoos. Far from a relic from an unenlightened past, remnants of such exhibits have continued in Europe as late as the 2000′s. Above photograph is from  Brussels, Belgium in 1958.

We have been seeing this indifference creep up throughout eras - in kingdoms, in rich households, in daily occupations like against farmers [ see the recent movie 12 years a slave and many like them depict such stories reminding us of this intolerable human behaviour and most recently even in entertainment shows like American Idol .

From hikes in killings; to daily events in society ; to educational institutes and what have you.  All of these inconvenience and hatred spewed among humans, friends, associates, acquaintances and many a time even amidst strangers is due to a complex feeling, a notion what we may call as an allergic reaction to social inclinations of choices, assumptions of self supremacy, and the very dominating "looking down on others" syndrome which many are victim of , even in this very modern era.
